Terms of Services

Introduction

This iBayar.my Terms of Service (the “Agreement”) contains the terms and conditions that govern your access to and use of the service offerings (as defined below) and is an agreement between Myclass Technologies Sdn. Bhd (iBayar). and you or the entity you represent. This agreement takes effect when You click an “I Accept” button or check box presented with these terms, or when you use any of the services. You represent to us that you are lawfully able to enter contracts. If you are entering into this Agreement for an entity, such as the company you work for, you represent to us that you have legal authority to bind that entity. You acknowledge that you have read the Agreement, and you agree to its terms and conditions and all policies posted on the iBayar.my Website.

Definitions and Interpretations

“Business Hours” refers to a period of time commencing from 10.00 a.m. to 5.30 p.m. on any Monday to Friday excluding a Public Holiday based on Malaysia calendar.

“iBayar.my Website” refers to the Site located at the URL https://iurus.co, https://iurus.co or any other successor sites owned or maintained by Myclass Technologies Sdn Bhd and Elzar Shariah Solutions Sdn Bhd

“Services” refers to the web services made available by iBayar.my or its affiliates or merchants.

Fees and Payment

• One Time Fees, such as setup fees are payable on your first-time registration.
• Full Payment.  All payments including monthly fee due to IBayar.my under this Agreement shall be made in full, without deduction for any reason.
• Late Fees.  Any payment not received within 4 times of follow-up will be assessed a late payment fee. Your subscription will be cancelled if iBayar.my did not get any response from you.
• We may also use recurring payment features where our platform may deduct from your bank’s account, credit card/ debit card or e-wallet automatically on monthly basis in accordance with agreed upon tenure of the agreement of the service. 
• Please note that we do not keep your Card and bank’s detail as those data are being insert into payment gateway platform upon checking out, hence we shall not be liable of any leaked of such data.

Limitation of Liability

• You expressly understand and agree that, to the extent permitted by applicable laws, iBayar.my shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the Service.
• To the extent permitted by applicable laws, in no event shall iBayar.my or our suppliers be liable for lost profits or any special, incidental, or consequential damages arising out of or in connection with our site, our Services or these Terms of Service (however arising including negligence). You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, affiliates, IBayar.my partners, officers, directors, agents, employees, and suppliers harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents it incorporates by reference (including the AUP), or your violation of any law or the rights of a third party.
• Your use of the Services is at your sole risk. The Services are provided on an “as is” and “as available” basis without any warranty or condition, express, implied or statutory.
• iBayar.my does not warrant that the Services will be uninterrupted, timely, secure, or error-free.
• iBayar.my does not warrant that the results that may be obtained from the use of the Services will be accurate or reliable.
• iBayar.my is not responsible for any of your tax obligations or liabilities related to the use of IBayar.my’s Services.
• iBayar.my does not warrant that the quality of any products, services, information, or other materials purchased or obtained by you through the Services will meet your expectations, or that any errors in the Services will be corrected.

Use of the Service Offerings

• Your Account. To access the services, you must create an iBayar.my Merchant Account associated with a valid phone number and e-mail address. You are also known as Primary Contact of your account. Unless explicitly permitted by the Terms of Service, you may only create one account per contact number and email address. You are responsible for all activities that occur under your account, regardless of whether the activities are undertaken by you, your employees or a third party (including your contractors or agents) and, except to extent caused by our breach of Agreement.
• Unauthorized Access. iBayar.my and its affiliates are not responsible for unauthorized access to your account. You shall contact us immediately if you believe an unauthorized third party may be using your account or if your account information is lost or stolen.

Provision of Services

• Maintenance of Hardware and Software. Unless otherwise indicated in this Agreement, the services shall not include the provision or maintenance of any computer equipment or software required by you to connect to the iBayar.my Internet Server.
• Right to Suspend. iBayar.my reserves the right to suspend the services or delete fraud account or any part of them for operational reasons or in an emergency and you shall not make any claim or compensation from iBayar.my.

Security Of Data.

• Unauthorized Access. You agree that iBayar.my is not liable for any unauthorized access to your data even when the access occurs as a result of a fault in equipment or software owned, operated or supplied by iBayar.my.
• Other Security. You are responsible for properly configuring and using the services and taking the necessary steps to maintain appropriate security and protection of your content, from unauthorized access and make routine archiving of your content.

Subdomain Name

You must create your subdomain name by your own and once confirmed, the subdomain name is not able to be changed.

Temporary Suspension

Generally. iBayar.my may suspend your account or any End User’s right to access or use any portion or all the services immediately upon notice to you if we determine:

• You or an End User’s use of the services

1. Poses a security risk to the services or any third party.
2. May adversely impact the services or the systems or content of any other iBayar.my customer.
3. May subject us, our affiliates, or any third party to liability.

• You are, or any End User is, in breach of this Agreement.
• You are delinquent on your payment obligations for more than 4 follow-ups.

Service Termination

If you want terminates your account, iBayar.my will terminate/delete your database/account on the day you specify the account is cancelled.

Effect of Termination

If iBayar.my terminates your right to access or use any portion or all the services:

• You remain responsible for all fees and charges you have incurred prior the date of termination.
• iBayar.my will erase all your content as a result of your termination, except as specified elsewhere in this Agreement.
• Any such termination shall not be a breach by iBayar.my of this Agreement.

Termination & Suspension – Convenience & Cause

iBayar.my hopes that You will choose to stick with iBayar.my as your software provider.  However, there may come a time where you (or iBayar.my) chooses to suspend or terminate your access to and/or use of Services.  We want you to be aware of both your and iBayar.my’s suspension and termination rights.

Termination for Convenience. iBayar.my may, for any reason or no reason, suspend or terminate this Agreement, Permit Authorization, Your or Your User’s access to and/or use of Services, and/or reduce to zero (0) the number of Doors, effective upon the expiration of the then current Term, by notifying You in writing at least five (5) business days prior to the end of the current Term. You may terminate this Agreement by notifying iBayar.my in writing in accordance with this Agreement’s Notice provisions, at least five (5) business days prior to the end of the current Term.

Termination for Cause. iBayar.my may, in its sole and absolute discretion, immediately suspend or terminate this Agreement, Permit Authorization, Your or Your User’s access to and/or use of Services, and/or reduce to zero (0) the number of Doors, if iBayar.my believes in its sole discretion that You or any User has breached or failed to comply with any provision of this Agreement, or as the case may be, with iBAYAR.MY’S PORTAL TERMS & CONDITIONS. 

Moreover, upon termination for cause, Customer’s and User’s right to access or use Services as well as to Customer’s data, User’s data, Client’s Data, or any then existing files, electronic messages, or other information belonging to Customer, User or Customer’s clients (collectively, “Total Data”), shall immediately cease, and iBayar.my shall have no further obligations under or pursuant to this Agreement.

Termination of Free Accounts or Demo Accounts.

iBayar.my has the absolute right, without prior notice to You, to suspend, terminate or otherwise cancel a free trial at any time and for any reason or no reason.

Amounts Owed. In the event of any termination or suspension of this Agreement, You agree to pay the balance due on Customer’s account, including any and all outstanding Usage Fee, Additional Fee, Late Fee and the like (collectively, “Amounts Owed”).  You authorize iBayar.my to charge Amounts Owed to Your credit card, debit card, or bank account on file with iBayar.my, or otherwise bill You for such Amounts Owed.

Total Data Upon Termination. In the event this Agreement or Your access to Services is terminated or suspended, You will have ninety (90) days from the date of the termination to reactivate Your account, which is up to iBayar.my in their sole and absolute discretion, after which iBayar.my may, in its sole and absolute discretion and without notice or liability, withhold access to, remove, discard, or delete Total Data, or otherwise do with Total Data as IBayar.my determines to be in its business interests.   

Hold(s). You understand and agree that in the event of any termination or suspension of this Agreement, IBayar.my may (in its sole and absolute discretion) to hold (i.e., not disburse) monies to You, for an indeterminable amount of time, but that IBayar.my agrees to work with You in good faith to timely resolve any and all such holds. 

Notwithstanding any such hold, You understand and agree that iBayar.my shall not be responsible for, without limitation, any penalties, fees, charges, or interest associated with any such hold(s), and that you will fully indemnify, hold harmless and defend (as requested by iBayar.my) with respect to such.

Suggestions

If you provide any suggestions to iBayar.my or its affiliates, iBayar.my will own all rights, titles, and interests in and to the suggestions, even if you have designated the suggestions as confidential. IBayar.my and its affiliates will be entitled to use the suggestions without restriction. You hereby irrevocably assign to iBayar.my all rights, titles, and interests in and to the suggestions and agree to provide us any assistance we may require documenting, perfect, and maintain our rights in the suggestions.

Changes

iBayar.my may change, discontinue, or deprecate any of the services (including the services as a whole) or change or remove features or functionality of the services from time to time. IBayar.my have a right to not notify you of any material change to or discontinuation of the services.

Amendment. iBayar.my reserves the right to modify, in its sole and absolute discretion, this Agreement at any time effective upon posting of an updated version of this Agreement. You are responsible for regularly reviewing this Agreement and Your (or any authorized User’s) use or accessing of the Service after any such changes shall constitute Your (and their) consent to such modification(s).

Notwithstanding, any modification(s) to this Agreement shall not apply to a dispute between You and iBayar.my arising prior to the effective date of any such modification(s).

Cancellation and Refund

You can cancel your subscription at any time. Please note that your confirmation cancellation within 24 working hours. Refunds will not be provided for any subscription that had been cancelled.

We do not provide credit, refunds or prorated billing for subscriptions that are cancelled within active period of any subscription of package.

Please use the Free Package with 14 days trial (Demo Account) with free registration to make sure that the software meets your needs before purchasing a license. If module doesn’t have an online demo, read it’s detail page carefully including User Guide available publicly on product detail page.
